TRUSTEE(S NOTICE OF SALE Reference is made to that certain Trust Deed made by ALICE K. WARNER as Grantor, to AMERITITLE, a title insurance company, as Trustee, in favor of THOMAS M. CARLSON, Trustee of the THOMAS M. CARLSON 1989 LIVING TRUST, as Beneficiary, dated September 21, 2011 and recorded September 22, 2011, as Instrument No. 2011-006981, in the Real Property Records of Columbia County, Oregon (Trust Deed), covering the following described real property situated in the above mentioned County and State: Described in the attached EXHIBIT A APN: 12434 Commonly known as: 119 May Avenue, Saint Helens, OR 97051 (the Property) The Beneficiary and the Successor Trustee have elected to foreclose the Trust Deed by advertisement and sale to satisfy the obligations that the Trust Deed secures and a Notice of Default and Election to Sell has been recorded pursuant to Oregon Revised Statutes 86.752. The defaults for which the foreclosure is made are: Unpaid principal and interest as of August 28, 2017 in the total amount of $71,732.71, with interest continuing to accrue thereafter at the rate of eight percent (8%) per annum, until paid. Based upon the default, the Beneficiary has declared all sums owing on the obligation that the Trust Deed secures immediately due and payable, those sums being the following: Principal and interest in the amount of $71,732.71, with interest accruing at the rate of eight percent (8%) per annum, from August 28, 2017 until paid; attorney’s fees, trustee’s fees, together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by the Beneficiary as allowed by the Note and Trust Deed. WHEREFORE, the undersigned Trustee will on Thursday, January 18, 2018, at 1:00 P.M., in accord with the standard of time established by ORS 187.110, at the Front Steps of the Columbia County Courthouse located at 230 Strand St, St Helens, OR 97051, sell at public auction to the highest bidder for cash the interest in the Property which the Grantor has to satisfy the obligations secured by the Trust Deed and the expenses of sale, including the compensation of the Trustee and the Trustee(s attorneys. The Grantor, the Grantor(s successor in interest to all or any part of the Property, any Beneficiary under a subordinate trust deed, or any person having a subordinate lien or encumbrance of record on the Property, have the right under ORS 86.778 to have this foreclosure proceeding dismissed and the Trust Deed reinstated by (1) payment of the entire amount then due, other than that portion that would not then be due had no default occurred, together with all costs and expenses actually incurred in enforcing the obligation and Trust Deed, including Trustee(s fees and attorney fees as allowed by ORS 86.729; with payment to be made at any time that is not later than five days before the date last set for the sale, and (2) by curing any other default described herein.
