NOTICE OF PUBLIC HEARING City of Happy Valley Hearings Officer & Design Review Board Notice is hereby given that the City of Happy Valley Hearings Officer and Design Review Board will hold public hearings on the following dates in regard to the applications described herein: Date & Time: Hearings Officer – December 14, 2017 at 9:00 a.m. Design Review Board – January 17, 2018 at 7:00 p.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086; File & Subject: File Nos. CUP-01-17/ERP-07-17/VAR-04-17, and DR-18-17 THE VOGEL ROAD ELEMENTARY SCHOOL: CONDITIONAL USE PERMIT; ENVIRONMENTAL REVIEW PERMIT; VARIANCE; AND, MAJOR DESIGN REVIEW. Proposal: The applicant proposes to develop a 61,700 square feet, 24 classroom elementary school (the Vogel Road Elementary School), 78 parking spaces, and associated drive-aisles and landscaped areas on an approximately 10.3-acre site, and is seeking approval of a Conditional Use Permit (for the proposed use); an Environmental Review Permit (due to the presence of natural resources); a Class C Variance; and, and Major Design Review application (for the building and site design) on two tax lots comprising 10.3 acres. Location: 18031 SE Vogel Road, approximately 2000 feet east of 172nd Avenue; the site is further described as Clackamas County Assessor Map Number 23E06AA: Tax Lot 1500 and the northern 2.4 acres of Map Number 22E06AA: Tax Lot 1400. Applicant: North Clackamas School District #12. Applicable Criteria: Applicable sections of the Clackamas County Zoning and Development Ordinance (ZDO), including Section 316; and applicable sections of the City of Happy Valley Municipal Code; Title 16 (Land Development Code): Chapters 16.34, 16.41, 16.42, 16.43, 16.46, 16.50, 16.61, 16.62, 16.64, and 16.71. Written testimony may be submitted in advance or in person at the hearings. Those wishing to present verbal testimony, either pro, con, or to raise questions, will be asked to speak after presentation of the report. Testimony should pertain to the applicable criteria. The decision by the Hearing’s Officer and the decision by the Design Review Board will be made in accordance with above criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Wednesday, November 29, 2017 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the hearing body an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow this Commission to respond to the issue precludes an action for damages in circuit court.
