TRUSTEE’S NOTICE OF SALE Reference is made to that certain Trust Deed in which VERNON LOUIS WOODALL is the Grantor, MCEWEN GISVOLD LLP, is the Successor Trustee, made in favor of LEWIS HANSON AND COMPANY, INC, TRUSTEE FOR WOODALL, LOT 30 LOAN, as Beneficiary August 13, 2008 and recorded August 15, 2008, as Instrument No. 2008 070958, in the Real Property Records of Washington County, Oregon (Trust Deed), covering the following described real property situated in the above mentioned County and State: LOT 30, WITCH HAZEL LITTLE FARMS, a Plat of record in the City of Hillsboro, County of Washington and State of Oregon APN: R342837 (the Property) The Beneficiary and the Successor Trustee have elected to foreclose the Trust Deed by advertisement and sale to satisfy the obligations that the Trust Deed secures and a Notice of Default and Election to Sell has been recorded pursuant to Oregon Revised Statutes 86.752. The defaults for which the foreclosure is made are: Unpaid monthly payments of $5,375.00 each, commencing from October 15, 2009, and continuing thereafter, plus real property taxes assessed from 2009-2018 in the amount of $4,823.10. Based upon the default, the Beneficiary has declared all sums owing on the obligation that the Trust Deed secures immediately due and payable, those sums being the following: Principal in the amount of $483,481.74 as of September 15, 2010, with interest through March 12, 2018 in the amount of $993,347.42 and continuing thereafter at the rate of fifteen percent (15%) per annum, until paid; attorney’s fees, trustee’s fees, together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by the Beneficiary as allowed by the Note and Trust Deed. In addition, pursuant to the Trust Deed, the Property has been pledged as additional collateral for a loan reflected in the Deed of Trust recorded August 15, 2008, as Instrument No. 2008 070959, on which is due principal in the amount of $435,099.38 as of September 15, 2010, with interest through March 12, 2018 in the amount of $893,942.44. WHEREFORE, the undersigned Trustee will on Tuesday August 7, 2018, at 1:00 P.M., in accord with the standard of time established by ORS 187.110, at the Front Steps of the Washington County Courthouse located at 123 E Main St, Hillsboro, OR 97123, sell at public auction to the highest bidder for cash the interest in the Property which the Grantor has to satisfy the obligations secured by the Trust Deed and the expenses of sale, including the compensation of the Trustee and the Trustee=s attorneys. The Grantor, the Grantor=s successor in interest to all or any part of the Property, any Beneficiary under a subordinate trust deed, or any person having a subordinate lien or encumbrance of record on the Property, have the right under ORS 86.778 to have this foreclosure proceeding dismissed and the Trust Deed reinstated by (1) payment of the entire amount then due, other than that portion that would not then be due had no default occurred, together with all costs and expenses actually incurred in enforcing the obligation and Trust Deed, including Trustee=s fees and attorney fees as allowed by ORS 86.729; with payment to be made at any time that is not later than five days before the date last set for the sale, and (2) by curing any other default described herein. In construing this notice, the singular includes the plural, the word grantor includes any successor in interest to the Grantor as well as any other person owing an obligation, the performance of which is secured by the Trust Deed, and the words Trustee and Beneficiary include their respective successors in interest, if any.
