NOTICE OF PUBLIC HEARING BEFORE THE CITY COUNCIL (Legislative – LOC 50.07.003.16.e) Hearing Date, Time, and Location: Tuesday, June 5, 2018; 6:30 p.m. City Council Chambers 380 A Avenue Lake Oswego, OR 97034 File Numbers: LU 18-0007 (Ordinance 2783) Applicant: City of Lake Oswego Nature of Application and Proposed Legislative Amendments: A request from the City of Lake Oswego for annual text amendment to the Community Development Code (CDC) to correct cross-references, clarify standards, and address landscape waivers, permitted uses in Parks Plans, mid-week Farmer’s Markets, courtyard size in Downtown Redevelopment Design District, and the definition of Detached. Amends: LOC 50.01.004.1; 50.03.002.3; 50.03.003.5; 50.03.005.5; 50.04.003.6; 50.05.001.5; 50.05.004.5, 8, 9 and 13; 50.05.007.4, 6 and 7; 50.05.010.5; 50.06.002.1; 50.06.003.3; 50.07.003.1 and 3; 50.07.007.1 and 3; and 50.10.003.2. The Code Amendments include maintenance amendments, such as clarifications and corrections, as well as policy amendments. The amendments include the following: — Through Lots: Clarifies the setback determination. — Tree Terminology and Mitigation in Lake Grove Village Center Overlay: Corrects tree terminology, size of regulated trees, and clarifies that mitigation is not required for invasive trees within the Overlay. — Code Standard Lock-in: For subdivision approvals, code standards are locked in for three years. — Farmers’ Market: Permits a mid-week farmers’ market with the same restrictions that apply to Saturday Market. — Courtyards: Establishes minimum dimensions for required courtyards in the Downtown Redevelopment Design (DRD) District. On May 14, 2018, the Planning Commission made a final recommendation that the City Council approve the proposed amendments. The title of the ordinance is as follows: Ordinance 2783 An ordinance of the Lake Oswego City Council amending LOC Chapter 50 (Community Development Code) for the purpose of clarifying and updating various provisions (2018), including Setbacks on Through Lots, Tree Terminology and Mitigation in the Lake Grove Village Center Overlay, Courtyard Dimensions in the Downtown Redevelopment Design District, and Detached Definition; and adopting findings (LU 18-0007).
