IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR CLACKAMAS COUNTY Case No. 18CV19211 NOTICE AND SERVICE OF COMMENCEMENT PLEADING BY PUBLICATION In the matter of Validation Proceeding to Determine Regularity and Legality of the City of Milwaukie’s Contracts and Decisions in Connection with Resolution 18-2016 TO: City of Milwaukie (City) and All Electors, Freeholders, Taxpayers and Other Interested Persons of the City of Milwaukie, a municipal corporation, the City Council (Council) for the City has commenced the above described validation proceeding in the Clackamas County Circuit Court to determine the regularity and legality of the expenditure by the City and Council of library improvement funds. On May 17, 2016, the City’s voters approved City of Milwaukie Measures 3-477 (Measure) which authorized to City to issue up to $9,200,000 of general obligation bonds to fund the improvement of the Ledding Library (Library) in the City. In the above-entitled validation proceeding, the City and Council seek a judgment pursuant to ORS 33.710, et. seq.: (1) that the City’s proposed improvements to the Library authorized by the City of Milwaukie Planning Division’s April 13, 2018 Notice of Decision, and the City’s proposal to sell the Pond House located on the library property in order to further fund improvements to the library are consistent with the Measure and (2) that the City’s use of bond proceeds to fund these improvements is consistent with the Measures. The commencement pleading is available for review in the office of the Clerk of the Court, or from the undersigned at the address shown below.
