NOTICE OF INTENT TO ENFORCE CONTRACT FULFILLMENT UNDER ORS 93.285(7)(a) and (8) NOTICE IS GIVEN that the seller of real property, THE ESTATE OF ALMA SCHARN, has received full payment and performance of the Memorandum of Contract dated July 17, 1985, as recorded in the Marion County records on July 29, 1985, in Reel 405, Page 169, between THE ESTATE OF ALMA SCHARN, by Myron L. Scharn, Personal Representative (Seller) and SUSAN MARGARET HEBERT (Purchaser) for transfer or conveyance of an interest in real property, but has failed or refused to provide the Purchaser with a proper deed of conveyance. Final payment was received by Seller from Purchaser on July 17, 1995, and Purchaser wishes to enforce a contractual requirement for delivery of a deed of conveyance from the Seller. 1. Name of the Seller: Estate of Alma Scharn, by Myron L. Scharn, Personal Representative 2. Memorandum of Contract dated July 17, 1985, recorded in Reel 405, Page 169, Marion County Deed Records, on July 29, 1985. 3. The legal description of the real property is as follows: Beginning on the East line of Sixth Street, now Capitol Street, in Good Addition to Salem, Marion County, Oregon, at a point which is 150 feet Southerly of the point where said East line intersects the South line of Washington Street, now Howard Street; and running thence East 103 feet, more or less, to the West line of the tract of land conveyed to R.F. Polanski and Margaret Dora Polanski, by deed recorded in Volume 323, Page 249, Deed Records for Marion County, Oregon; thence Southerly along the West line of said Polanski tract, 53 feet; thence West 103 feet, more or less, to the East line of Sixth Street, thence Northerly along the East line of Sixth Street, 53 feet to the place of beginning, and being a part of Lot 7, Tuxedo Addition to Salem, Marion County, Oregon, and a part of Block 2, Good Addition to Salem, being a subdivision of Part of Lots 6 and 7, Tuxedo Park Addition to Salem, Marion County, Oregon. Together with the improvements thereon, including the window treatments, electric range, trash burner, stove, and picnic table. 4. Name of the Purchaser: Susan Margaret Hebert 5. Seller or Seller’s successors in interest or assignees must submit an objection to the Purchaser within 60 days after the final date of publication of the notice required by ORS 93.285(7)(a) or within 120 days after the date of recording of the notice required by ORS 93.285(3)(b), whichever is later, or the Seller’s interest in the property may be conveyed to the Purchaser. 8.
