NOTICE OF PUBLIC HEARING City of Happy Valley Hearings Officer Notice is hereby given that the City of Happy Valley Hearings Officer will hold a public hearing on the following date regarding the 60 proposed single-family attached townhomes. Date & Time: Hearings Officer – Thursday, July 26, 2018 at 9:00 a.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086 File & Subject: File No. DR-09-18: Pleasant Valley Villages (Phases 1-2) Attached Townhomes Proposal: Design Review to allow development of 60 single-family attached townhomes within the previously-approved Pleasant Valley Villages Planned Unit Development (Phases 1-2). The townhomes are proposed for Lots 1-24 (Phase 1) and Lots 81-98 and 109-126 (Phase 2). Location: 12525 SE 172nd Avenue (on the west side of 172nd Avenue, approximately 120 feet north of the intersection of 172nd Avenue and Tristin Avenue); Clackamas County Assessor Map No. 23E06BA: Tax Lots 100, 2200, 2280 and 2290. The final decision by the Hearings Officer will be made in accordance with said criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Friday, June 29, 2018 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the Hearings Officer an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Hearings Officer to respond to the issue precludes an action for damages in circuit court.
