NOTICE OF DEFAULT AND FORECLOSURE SALE WHEREAS, on 4/14/2003, a certain Mortgage Deed of Trust was executed by BETTY L KANE, A SINGLE PERSON as trustor in favor of WELLS FARGO HOME MORTGAGE, INC., A CALIFORNIA CORPORATION as beneficiary, and was recorded on 4/21/2003, as Instrument No. 2003-001895, in the Office of the Recorder of Jefferson County, Oregon; and WHEREAS, the beneficial interest in the Mortgage Deed of Trust is now owned by the Secretary, pursuant to an assignment dated 6/7/2011, recorded on 6/27/2011, as instrument number 2011-2024, in the office of Jefferson County, Oregon; and WHEREAS, a default has been made in the covenants and conditions of the Mortgage Deed of Trust in that the payment due upon the move out of the borrower was not made and remains wholly unpaid as of the date of this notice, and no payment has been made sufficient to restore the loan to currency; and WHEREAS, the entire amount delinquent as of 7/12/2018 is $183,766.28; and WHEREAS, the Mortgage Deed of Trust was insured by the United States Secretary of Housing and Urban Development (the Secretary) pursuant to the National Housing Act for the purpose of providing single family house; and WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Mortgage Deed of Trust to be immediately due and payable; NOW THEREFORE, pursuant to powers vested in me by the Single Family Mortgage Foreclosure Act of 1994, 12 U.S.C. 3751 et seq., by 24 CFR part 27, subpart B, and by the Secretary’s designation of me as Foreclosure Commissioner, notice is hereby given that on 8/21/2018 at 11:00 AM local time, all real and personal property at or used in connection with the following described premises (Property) will be sold at public auction to the highest bidder: Legal Description: Beginning at an iron rod on the Southerly right of way line of Shad Road, said point being North 5196.63 feet and East 4895.64 feet from the Southwest corner of Section 22, Township 13 South, Range 12 East of the Willamette Meridian, Jefferson County, Oregon, thence South 767.56 feet to an iron rod; thence West 315.00 feet to an iron rod; thence North 770.03 feet to an iron rod on said Southerly right of way line; thence South 89deg. 33′ 04 East along said Southerly right of way line 315.01 feet to the point of beginning.
