TRUSTEE’S NOTICE OF SALE Reference is made to that certain trust deed made by MACGREGOR LAND COMPANY, an Oregon corporation, as Grantor, to First American Title Company of Oregon, as Trustee, in favor of SCOTSMAN ENTERPRISES LLC, an Oregon limited liability company as Beneficiary, dated January 7, 2016, recorded January 11, 2016, in the Records of Columbia County, Oregon, as Instrument No. 2016-000126, which trust deed was amended under an Amendment to Trust Deed dated January 17, 2017, recorded January 25, 2017, in the Records of Columbia County, Oregon, as Instrument No. 2017-000665 covering the following described real property situated in said county and state, to wit: Parcel 2 of Partition Plat 2007-29, recorded September 26, 2007 as Instrument Number 2007-012396, in Columbia County, Oregon, and corrected by that Affidavit of Correction recorded May 12, 2008 as Instrument Number 2008-004769 in Columbia County, Oregon. Both the Beneficiary and the Trustee have elected to sell the said real property to satisfy the obligations secured by said Trust Deed and a Notice of Default has been recorded pursuant to Oregon Revised Statutes 86.752 (3); the default for which the foreclosure is made is Grantor’s failure to pay when due the following sums: Failure to pay monthly installment payments of $4,000.00 each due June 2017 through May 2018 totaling $48,000.00, along with monthly late fees for June 2017 through May 2018 in the amount of $4,800.00, for an aggregate total of $52,800.00, together with all accruing real property taxes owing including interest thereon; together with the cost of title search, recording fees, trustee’s fees, additional attorney’s fees and all cost incurred in this proceeding (*Note matures on July 17, 2018 and additional late fees are due at maturity). By reason of the default, the Beneficiary has declared all sums owing on the obligation secured by the Trust Deed immediately due and payable, the sums being the following, to wit: Unpaid principal balance of $400,000.00 plus interest to May 31, 2017 accruing at 12% and default interest from June 1, 2017 accruing at 18% per annum, together with late charges, and together with all accruing real property taxes owing including interest thereon; together with the costs of title search, recording fees, trustee’s fees, additional attorney’s fees and all costs incurred in this proceeding. WHEREFORE, notice hereby is given that the undersigned Trustee will on FRIDAY, OCTOBER 19, 2018, at the hour of 12:00p.m., in accord with the standard of time established by ORS 187.110, at the west entrance of the Columbia County Courthouse, 230 Strand Street, St. Helens, Oregon 97051, State of Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantor had or had power to convey at the time of the execution by him of the said Trust Deed, together with any interest which the Grantor or his successors in interest acquired after the execution of said Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the Trustee. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or Trust Deed, and in addition to paying said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with trustee’s and attorney’s fees not exceeding the amounts provided by said ORS 86.778. Without limiting the Trustee’s disclaimer of representations or warranties, Oregon law requires the Trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale. In construing this notice, the masculine gender includes the feminine and the neuter, the singular incudes the plural, the word Grantor incudes any successor in interest to the Grantor as well as any other person owing an obligation, the performance of which is secured by said Trust Deed, and the words Trustee and Beneficiary include their respective successors in interest, if any.
