TRUSTEE’S NOTICE OF SALE The Trustee under the terms of the Trust Deed described herein, at the direction of the Beneficiary, hereby elects to sell the property described in the Trust Deed to satisfy the obligations secured thereby. Pursuant to ORS 86.771, the following information is provided: 1. PARTIES: Grantor: TRACY A PEETS AND PATRICK A PEETS Trustee: COLUMBIA COUNTY TITLE COMPANY Successor Trustee: NANCY K. CARY Beneficiary: WASHINGTON FEDERAL, N.A., FKA WASHINGTON FEDERAL SAVINGS AND LOAN, SUCCESSOR BY MERGER TO FIRST MUTUAL BANK 2. DESCRIPTION OF PROPERTY: The real property is described as follows: A tract of land in Sections 3 and 4, Township 4 North, Range 4 West of the Willamette Meridian, Columbia County, Oregon, more particularly described as follows: Beginning at a point which is South 0deg.26′ West 203.8 feet from the Southwest corner of Section 34, Township 5 North, Range 4 West of the Willamette Meridian, in Columbia County, Oregon said beginning point being on the South line of that certain tract of land conveyed by S,V. Malmsten and Minnie Malmsten, husband and wife, to Floyd Cleveland and Della F. Cleveland by deed recorded in Book 41, page 505, Deed Records of Columbia County, Oregon; thence South 87deg.16′ East along said South line of said Cleveland land 297.9 feet to an iron pipe on the West line of county road; thence along the West line of said road, on a curve, the chord of which bears South 2deg.15′ West 102.9 feet to an iron pipe at the Northeast corner of tract of land conveyed by C.I, Anderson and Trilla Anderson, husband and wife, to said Malmsten and wife by deed recorded in Book 43, page 67, Deed Records of Columbia County, Oregon; thence North 87deg.16′ West 338.6 feet to an iron pipe on the East bank of the Nehalem River; thence continuing on said course 55 feet to the low water line of said stream; thence following down said low water line in a Northwesterly direction 120 feet; thence South 87deg.16′ East 50 feet to an iron pipe on the bank of said stream, and thence continuing South 87deg.16′ East 11 O feet to the place of beginning. 3. RECORDING. The Trust Deed was recorded as follows: Date Recorded: July 31, 2007 Recording No. 2007-010030 Official Records of Columbia County, Oregon 4. DEFAULT. The Grantor or any other person obligated on the Trust Deed and Promissory Note secured thereby is in default and the Beneficiary seeks to foreclose the Trust Deed for failure to pay: The entire prinicpal balance of $151,776.09, which matured on July 1, 2017; plus late charges and advances; plus any unpaid real property taxes or liens, plus interest. 5. AMOUNT DUE. The amount due on the Note which is secured by the Trust Deed referred to herein is: Principal balance in the amount of $151,776.09; plus interest at the rate of 6.50% per annum from June 1, 2017; plus advances and foreclosure attorney fees and costs. 6. SALE OF PROPERTY. The Trustee hereby states that the property will be sold to satisfy the obligations secured by the Trust Deed. A Trustee’s Notice of Default and Election to Sell Under Terms of Trust Deed has been recorded in the Official Records of Columbia County, Oregon. 7. TIME OF SALE. Date: November 15, 2018 Time: 11:00 a.m. Place: Columbia County Courthouse, 230 Strand Street, St. Helens, Oregon 8. RIGHT TO REINSTATE. Any person named in ORS 86.778 has the right, at any time that is not later than five days before the Trustee conducts the sale, to have this foreclosure dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due, other than such portion of the principal as would not then be due had no default occurred, by curing any other default that is capable of being cured by tendering the performance required under the obligation or Trust Deed and by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with the trustee’s and attorney’s fees not exceeding the amount provided in ORS 86.778. ___________________________________________________________ NOTICE REGARDING POTENTIAL HAZARDS (This notice is required for notices of sale sent on or after January 1, 2015.)
