Land Use Application impacting 3 properties

PUBLIC NOTICE PLANNING COMMISSION PUBLIC HEARING NOTICE IS HEREBY GIVEN: That the City of Fairview Planning Commission will hold a public hearing to review the following land use application at 6:30pm on Tuesday, October 9, 2018, in the Council Chambers of the Fairview City Hall, located at 1300 NE Village Street, Fairview, Oregon. Interested persons may appear and testify on the proposal. Case File No. 2018-69-TA impacting three properties: 21414 NE Sandy Blvd (1N3E28AC -100), 22820 NE Sandy Blvd (1N3E27B-1004), and 23012 NE Sandy Blvd (1N3E27B -1100) Meadow Outdoor Advertising is proposing a text amendment to Fairview Municipal Code (FMC) Chapter 19.170 Sign Regulations. Under the current code, new billboards and the reconstruction of existing billboards is prohibited. The text amendment would allow existing billboards that were legally constructed to be rebuilt on the same property in order to improve the structural and aesthetic nature of the signs. The amendment would also allow the reconstructed billboards to be increased in height, up to not more than 40 ft. above the adjacent roadway. In order to be rebuilt, the modified structure must include fewer supporting elements, thereby decreasing the visual impact of the supporting structure. The modification must also result in a smaller footprint on the ground. The proposed text amendment would apply to the existing billboards at the three above mentioned properties. The application will be reviewed for consistency with the following sections of the Fairview Municipal Code: — FMC 19.412 Description of Permit Procedures — FMC 19.413 Procedures — FMC 19.470 Land Use District Map & Text Amendments — FMC 19.205 Amendments — FMC 19.170 Sign Regulations The application is subject to the Type III review process in accordance with Fairview Municipal Code 19.415, which follows a quasi-judicial process. A decision on the above application may be made at the public hearing on October 9, 2018. When rendered, the decision will be mailed to the applicant and to anyone else who submitted written comments or who is otherwise legally entitled to notice. If you wish to appeal the request on a particular issue, that issue must be raised in writing prior to the hearing, or verbally within the public hearing. Issues must be raised with sufficient specificity to enable the decision-maker to respond to the issues. All evidence relied upon by the Planning Commission to make this decision is in the public record, available for public review. A copy of the staff report will be available seven days before the hearing. Copies of this evidence and the staff report can be obtained at a reasonable cost from the City.
