Public Notice: Crook County Planning Commission Public Hearing: Conditional Use – Residential Home Facility – Remand Hearing.

PUBLIC NOTICE REMAND HEARING, CONDITIONAL USE Notice is hereby given that the Crook County Planning Commission will hold a public hearing at 6:00 p.m. on Wednesday, October 10, 2018 in the Crook County Meeting Room, 320 NE Court Street, Prineville, Oregon to consider the following: Modification – Conditional Use -Residential Home Facility – Remand Hearing The Crook County Court voted unanimously to remand the decision of the Crook County Planning commission denying the residential care facility, proposed in the County’s SR-1 (Suburban Residential) zone, finding that the Planning Commission’s decision was based on a misinterpretation of applicable law. The County Court found that the Planning Commission erred in limiting its analysis to the impact of the proposed use on the residential neighborhood as it currently exists and not the impact of the proposed use compared to outright permitted uses that could be developed in the neighborhood as required by Crook county Code 18.160.020(2). Deborah Roe (owner) submitted a conditional use request to operate a residential home facility at 3391 NW Knob Hill Way, Prineville, Oregon – Record number 217-18-0000096-PLNG. Ms. Roe is currently operating a residential home (up to 5 residents) in an existing duplex. Ms. Roe requested conditional use approval to renovate the existing duplex into a single dwelling to serve as a residential care facility for up to 15 residents, subject to license requirement of the State of Oregon Department of Human Resources. Residential facilities are permitted as conditional uses under Crook County Code 18.48.020(14) and are reviewed under CCC18.160 (conditional uses). The property is identified as T 14S, R 16 E WM, Section 30A, Tax lot 3509.
