PUBLIC NOTICE Notice is hereby given that the City of Estacada Planning Commission will hold a Public Hearing on Thursday, December 6, 2018, beginning at 7:00 pm in the Estacada City Council Chambers, Estacada, Oregon, to consider the following applications. Conditional Use Application #2018-04-CU. The applicant, Tim Whiting, is requesting a conditional use according to Section 16.36.030 (A) to allow auto and light truck repair and service for property described as 1015 NW Noble Drive – 34E, 17B, tax lot 2400, which is zoned M-1 (light industrial). This application is subject to the criteria in Sections 16.36 and 16.88 of the Estacada City Code. Partition Application #2018-01-LP. The applicant, Gary Mengis, is requesting a three-lot partition of property described as 595 E 1st Ave – 34E, 21CC, tax lot 5100, which is zoned R-1 (low density residential). This application is subject to the criteria in Sections 16.16 and 16.104-16.120 of the Estacada City Code. Annexation and Subdivision Application #2018-03-S. The applicant, Greenworks Contractors LLC (Brett Grantham), is requesting annexation of property described as 34E, 28B, tax lot 1801 into the City limits of Estacada, and the City of Estacada is requesting a concurrent annexation of approximately 540 feet of adjacent County right-of-way for SE Darrow Rd. The application includes a corresponding zone change of the annexed parcel and the right-of-way from RRFF-5 (county designation) to R-1 (low density residential), consistent with the Estacada Comprehensive Plan Map. Concurrent with this annexation, the applicant is requesting a 24-lot residential subdivision of property that includes the proposed annexed parcel (tax lot 1801), as well as incorporated property described as 34E, 28B, tax lots 1800 & 1900, which are zoned R-1 (low density residential). The combined annexation and subdivision application is subject to the criteria in Section 16.16 and Sections 16.104-16.116 of the Estacada City Code, as well as applicable policies of the Comprehensive Plan. Subdivision location: 864 & 32950 SE Darrow Road. Upon recommendation by the Planning Commission, a final public hearing will be held by the City Council on Monday, January 14, 2019, at 7:00 pm in the Estacada City Council chambers. Ordinance #2018-007. An ordinance amending Estacada Development Code Chapters 16.08, 16.28, 16.32, 16.36, 16.62, 16.84, 16.112, and 16.116, and adding a new Chapter 16.66, to: allow mobile food carts in industrial and commercial areas, under certain standards; require an application for the verification of nonconforming uses; and clarify existing parking requirements for short-term rentals, the terms for dwellings, the minimum lot size for various dwelling types, and the period of tentative approval validity for subdivisions and phased developments. Upon recommendation by the Planning Commission, a final public hearing will be held by the City Council on Monday, January 14, 2019, at 7:00 pm in the Estacada City Council chambers. Anyone wishing to present written testimony on these proposed actions may do so in writing prior to or at the Public Hearing. Testimony and evidence must be directed toward the applicable approval criteria or other criteria, which a person believes to apply to the decision. Failure to raise an issue in a hearing, in person or by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue precludes appeal of the Commission’s decision based upon that issue. The final decision of the Estacada Planning Commission may be appealed to the City Council within 15 days of the Commission’s final decision date. A copy of the application and applicable criteria is available for inspection at no cost in the City Recorder’s Office at City Hall. Copies of the document will be provided at reasonable cost. A copy of the City’s staff report will be available for inspection at no cost at least seven days prior to the Public Hearing.
