NOTICE OF PUBLIC HEARING City of Happy Valley City Council NOTICE IS HEREBY GIVEN that the Happy Valley City Council will hold a public hearing to consider the annexation of territory pursuant to Section 16.67.070 of the City’s Land Development Code (LDC) in the City Hall Council Chambers, 16000 Misty Drive, Happy Valley, Oregon on Tuesday, January 15, 2019 at 7:00 p.m. DOCKET NUMBER: ANN-02-18/CPA-05-18/LDC-06-18 The affected area includes 12 tax lots totaling approximately 23.14 acres. 8 of the 12 properties are generally located east of the current City boundary in the western portion of the recently disincorporated City of Damascus; one property is located on Almond Court south of Sunnyside Road and east of 132nd Avenue; one property is located south of Hwy 212 and Southwest of Jennifer Street and 106th Avenue; and properties are north of Hwy 212, east of the intersection at 172nd Avenue and Armstrong Circle. The subject properties are further described as: 20660 SE Foster Rd; 19491 SE Foster Road; 21450 SE Foster Road; 12925 SE Almond Court; 16760 SE Robert Avenue; 17785 SE Armstrong Circle; 17925 SE Troge Road; 15920 SE Keller Road; 17717 SE Highway 212; and 18311 SE Foster Road. The subject properties are also described as Clackamas County Assessor Map Numbers: 23E05B 01100; 13E32B 00800; 22E02CD00400; 22E15B 00900; 23E05D 00209; 23E07AD00900; 13E31D 00205; 23E08C 00700; 13E29B 02500; 13E30A 01802; 13E30A 01900; and 23E07AD01100. The affected area also includes: A 40-foot wide section of right-of-way, known as Roberts Avenue, extending 475 feet north, from the southwestern corner of Clackamas County Assessor Map Number 22E15B 00700, to the northeastern corner of Clackamas County Assessor Map Number 22E15B 00700, then continuing east along a 60-foot wide section of right-of-way, known as Jennifer Street, 620 feet to the southwestern corner of Clackamas County Assessor Map Number 22E10C 06100, then continuing north along a of right-of-way, ranging from 60 feet to 70 feet in width, known as 106th Avenue, 1600 feet to the northwestern corner of Clackamas County Assessor Map Number 22E10C 02100; a 50-foot wide section of right-of-way, known as Almond Court, west from 132nd Avenue, 1000 feet more or less, to include the partial cul-de-sac right-of-way at the west end of said Almond Court; and, a 60-foot wide section of right-of-way, known as Tillstrom Road, along approximately 20 feet of width the eastern boundary of Clackamas County Assessor Map Number 13E30A 01900, across said right-of-way. The City Council intends to decide on the application for annexation of the above property at the public hearing. The Council may approve or deny an application for annexation in accordance with the applicable criteria of the City of Happy Valley Comprehensive Plan; Section 16.67.070 of the LDC; METRO Code Section 3.09; and, ORS 222.111, 222.125 and 222.170. The decision will be made in accordance with the said criteria, and may be appealed to the Land Use Board of Appeals.
