NOTICE OF PUBLIC HEARING City of Happy Valley Planning Commission Notice is hereby given that the City of Happy Valley Planning Commission will hold a public hearing on the following date regarding the proposed 58-Lot Planned Unit Development and Environmental Review Permit. Date & Time: Planning Commission – Tuesday, February 12, 2019 at 7:00 p.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086; File & Subject: File No. PUD-03-18/ERP-15-18: The Towns at Rock Creek Proposal: Planned Unit Development (PUD) and Environmental Review Permit (ERP) to allow development of a 58-lot PUD and Environmental Review Permit due to the presence of mapped natural resources on approximately 7.4 acres Location: 12400 and 12500 SE 172nd Avenue (approximately 1400 feet north of the intersection of 172nd Avenue and Vogel Road); Clackamas County Assessor Map No. 13E31D: Tax Lots 1901 and 2000. The final decision by the Planning Commission will be made in accordance with said criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Friday, December 28, 2018 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the Planning Commission an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Hearings Officer to respond to the issue precludes an action for damages in circuit court.
