Public Notice: Crook County Court Public Hearing: Appeal Aggregate Permit To Allow An Asphalt Batch Plant: On February 27, 2019.

NOTICE OF PUBLIC HEARING APPEAL AGGREGATE PERMIT TO ALLOW AN ASPHALT BATCH PLANT Notice is hereby given that the Crook County Court will hold a public hearing on Wednesday, February 27, 2019, at 3:30 p.m. The hearing will be held at the Crook County Annex Building at 320 NE Court St., Prineville, OR 97754. Kristy Cooper, Melvin Cooper, Andy Schutz, Tiina Allas, and Steve Harlan, the owners of the properties in the vicinity of the subject property have appealed the Crook County Planning Commission’s January 10, 2019 approval of a modification of applicant’s aggregate permit to allow an asphalt batch plant. The property is identified as Township 15S, Range 17E, Sections 8, 9, 16, and 17, Tax Lot 812, Crook County, Oregon. The hearing is being held pursuant to Crook County Code Title 18, Section 18.172.110. The hearing before the County Court shall be confined to the record of the proceedings below, as more specifically set forth in Crook County Code Section 18.172.110(12)(a). The appellant shall provide a copy of the transcript of the relevant portions of the proceedings appealed from to the Crook County Legal Department not less than seven (7) calendar days before the hearing date set by the County Court. A copy of the appeal and all documents and evidence relied upon by the appellant are available for inspection at no cost, and a copy will be provided at a reasonable cost. Failure of an issue to be raised in a hearing or by letter, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond to the issue, precludes appeal to the Land Use Board of Appeals (LUBA) based on that issue. Copies of the complete appeal packet to the County Court will be available for public review at no charge, and a copy will be available at a reasonable cost at least seven (7) days prior to the public hearing.
