CITY OF HILLSBORO NOTICE OF PUBLIC HEARINGS CASE FILE NOS.: AN-006-18 & ZC-009-18: RIVERSIDE AT RIVER BEND NOTICE IS HEREBY GIVEN that two public hearings will be held before the Hillsboro City Council at or shortly after 7:00 p.m., on Tuesday, March 19, 2019, in the Shirley Huffman Auditorium of the Civic Center, 150 E Main Street, Hillsboro. At the first hearing, the City Council will consider an application for annexation of three adjacent properties totaling approximately 11.38 acres in size into the City limits of Hillsboro. The purpose for annexation is to facilitate future development of the properties. The second hearing is for a City-initiated zone change to change the zoning of the three properties from Washington County FD-20 Future Development 20-Acre District to City MFR-1 Multi-Family Residential and SFR-7 Single Family Residential upon annexation. On February 27, 2019, the Planning Commission initiated the Zone Change to apply the MFR-1 Multi-Family Residential and SFR-7 Single Family Residential base zones upon annexation. The Community Development Code (CDC) includes special regulations for overlay zones, which are part of the official Zoning Map and are applied through City Council ordinances under procedures that are similar to those for base zones. The present zone change would apply the Regulatory Floodplain Overlay to portions of all three properties based on the October 19, 2018 Federal Emergency Management Agency flood maps, and a Significant Natural Resources Overlay would also be applied to the appropriate portions of the properties based on the City’s 2001 study of Goal 5 Natural Resources. The subject properties can be specifically identified as Tax Lots 802, 807 and 808 on Washington County Assessor’s Tax Map 1S2-16A. The site is generally located north of the Hillsboro Urban Growth Boundary, south of SE Oakhurst Street, east of the Tualatin River, and west of SW River Road. The property owners are Karen Summerall, Robert & Claudia Hale, and David & Sandra Rardon, and the applicant is Niki Munson, Riverside Homes, represented by Wayne Hanson, Pioneer Design Group. The applicable criteria for an annexation are listed in Metro Code Chapters 3.09.045 and 3.09.050 and Section 12.80.010 of the CDC. The applicable criteria for a zone change are listed in CDC Section 12.80.168. The CDC may be viewed online at or in the Planning Department office. Annexation of the property would also include its withdrawal from the Tualatin Valley Fire and Rescue District and inclusion into the Clean Water Services District. The annexation staff report will be available on Monday, March 4, 2019 at 4:00 p.m. The zone change staff report will be available on Tuesday, March 12, 2019 at 4:00 p.m. The complete application, staff reports, and all related criteria are available for public inspection at no cost, and/or copies can be provided at reasonable cost. These materials can be reviewed from 8:00 a.m. to 5:00 p.m. weekdays, excluding holidays, in the Planning Department at the Civic Center, 150 East Main Street, Fourth Floor, Hillsboro, Oregon. All interested persons are invited to attend this meeting and will be given an opportunity to be heard concerning the proposal. Oral testimony will be taken in the following order: applicant; other proponents; opponents; and applicant’s rebuttal. Oral testimony should avoid repetition of issues, and should be based on the application or on the approval criteria listed above. ORS 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant.
