NOTICE OF PUBLIC HEARINGS-City of North Plains NOTICE IS HEREBY GIVEN that on May 8, 2019, the City of North Plains Planning Commission will hold open Public Hearings to invite comments on the following submittals: City File Number 19-027- Veteran’s Park Zone Change. The city proposes to change the zoning of 0.26 acres of property zoned C-2 (Highway Commercial) to IPU (Institutional and Public Use). The purpose of the rezone is to develop a Veteran’s Park utilizing existing City property and the property proposed for rezone. Applicable zoning code sections are: 16.060 (Institutional and Public Use Zone) and 16.200 (Comprehensive Plan & Zoning Amendments). City File Number 19-028- Zoning Code Update- Partition Expiration Deadline Extended from 1 year to 2 Years The City is updating the Zoning Code to increase the approval period for minor land partitions from one year to two years. This is prompted by recent partitions requesting approval extensions to meet conditions of approval. Applicable zoning code section: 16.200 (Comprehensive Plan & Zoning Amendments). The public hearings will be held at 7:00 p.m. at the North Plains Senior Center, 31450 NW Commercial Street, North Plains, Oregon. Questions and written comments regarding the proposed changes are welcomed and can be directed to City Manager Andy Varner at andy.varner@northplains.org or by calling (503) 647-5555. All interested persons will be given the opportunity to be heard. Copies of the application are available for public review at City Hall, 31360 NW Commercial Street, North Plains, Oregon and the City’s website northplains.org. Copies of the Planning Commission staff report will be available no later than one week prior to the hearings. Written comments will be received until the public hearings are closed for the land use action. The public hearings will be conducted according to the process identified in Development Code Section 16.170. All evidence relied upon by the City to make these decisions is in the public record and available for public review at North Plains City Hall, North Plains, Oregon during regular business hours. Failure to raise an issue in sufficient detail during the comment period or at the public hearing may preclude an appeal to the Land Use Board of Appeals or Appeals/Circuit Court on that issue. Only comments on the applicable criteria are considered relevant evidence. The hearing will be opened for presentation by the city and the applicant and then opened to the public. The hearing can be closed or continued at the discretion of the hearing authority. If the hearing is closed, the hearing authority has the right to extend the time for additional information to be submitted by the public or the applicant. After the comment period closes on the final public hearing, the City shall issue a decision. The decision shall be mailed to the applicant and to anyone else who submitted written comments or who is otherwise legally entitled to notice.
