PUBLIC NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT and NOTICE OF REQUEST FOR RELEASE of COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (B-18-UC-41-0001) June 6, 2019 Clackamas County Community Development Division 2051 Kaen Road, Suite 245 Oregon City, Oregon 97045 (503) 655-8591 REQUEST FOR RELEASE OF FUNDS On or about July 10, 2019 the County of Clackamas will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of CDBG funds under Title I of the Housing and Community Development Act of l974 (PL 93-383) for the HeadStart Classroom Annex Project. The proposed new building is an addition to the existing Clackamas County Children’s Commission (CCCC) Campus at 16518 SE River Road, Milwaukie, Oregon. The Project will consist of the following improvements: grading, excavation of a designated area at the rear of the property. The new construction will be a permitted and complete 1 story structure. The new building will consist of 1 large classroom, 2 children’s restrooms, 2 mechanical room, 11 offices, 3 storage/ file rooms, 2 conference/ work rooms, and 2 adult restrooms. Construction materials will be a wooden structure built on an existing concrete foundation/ pad with existing rough plumbing, sewer, water, electrical, lighting, walls, with ADA access for the structure externally and internally. FINDING OF NO SIGNIFICANT IMPACT The County of Clackamas has conducted an Environmental Assessment and determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Community Development offices, 2051 Kaen Road, Suite 245, Oregon City, Oregon and may be examined or copied weekdays 8:30 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Clackamas County Community Development Division at the above address All comments received by July 9, 2019 will be considered by the County of Clackamas prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing. RELEASE OF FUNDS The County of Clackamas certifies to HUD that the County of Clackamas and Chuck Robbins, in his capacity as Community Development Director and Certifying Officer, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the County of Clackamas to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the County of Clackamas certification received by July 25, 2019 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the County of Clackamas approved by HUD; (b) the County of Clackamas has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD CPD, Green-Wyatt Federal Building, 1220 SW 3rd Avenue, Suite 400 Portland, OR 97204-2825. Potential objectors should contact HUD to verify the actual last day of the objection period. This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
