CITY OF HILLSBORO NOTICE OF PUBLIC HEARING CASE FILE NO.: TRMISC-001-19 SOHI LID CHANGE OF PROJECT LIST NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Council at or shortly after 7:00 p.m., on Tuesday, October 15, 2019, in the Shirley Huffman Auditorium of the Civic Center, 150 E Main Street, Hillsboro, Oregon. At the hearing, the City Council will consider a request to remove two projects in the South Hillsboro Local Improvement District (LID) and replace them with a related project. Property owners in the LID have requested to modify the LID Engineer’s Report in Sections 1 and 2 to remove 1) Transportation Development Tax (TDT) Project 1030, the widening of Cornelius Pass Road from the Tualatin Valley Highway to SE Frances Street; and 2) TDT Project 3054, the addition of a westbound turn lane at the intersection of Cornelius Pass Road and the Tualatin Valley Highway. Property owners additionally request that the related TDT Project 3049, the widening of SE Century Boulevard from SE Johnson Street to SE Alexander Street, be substituted in their place in Sections 1 and 2 of the LID Engineer’s Report. Staff have concluded that removing the two (2) projects and adding a related project will have no effect on the amount of the LID assessments, will not change the LID methodology and will allow the financial instruments and commitments made to proceed in a timely matter as originally planned. The City Attorney has reviewed the proposal and concluded that the proposed change to the LID Engineer’s Report is consistent with applicable Oregon Revised Statutes and Constitutional provisions governing local improvement districts and that the City Council has the full authority to make such a change to the LID. Since the LID has already been formed, a formal resolution declaring the City Council’s intent to form an LID is not required. However, staff have elected to follow the same public notification requirements to modify the LID Engineer’s Report as required to form the LID. The total estimated cost of the LID projects remains at $26,737,500 which includes the cost of the projects and all legal, administrative, construction, engineering, interest and other financing costs attributed to the LID. The LID cost estimate includes the fixed amount of $10,500,000 that the City will be obligated to pay to GLC-South Hillsboro LLC under the Reed’s Crossing Development Agreement dated July 5, 2016, and the fixed amount of $14,300,000 that the City will be obligated to pay to Washington County under the Intergovernmental Agreement between Washington County and the City of Hillsboro for the funding and construction of transportation improvements related to South Hillsboro dated June 28, 2016. The estimated legal and financing costs, and costs for city legal counsel, city bond counsel, interest, appraisals, a debt service reserve fund, and other financing costs through the date bonds are issued to finance the projects are estimated to be $1,937,500. However, this is an estimate, and the final actual cost that will be assessed to the benefited properties is subject to change. Hillsboro Municipal Code (HMC) Subchapter 3.16 sets forth the procedure and approval process for the development of a LID. The South Hillsboro Plan Area is described in Section 12.65 of the Hillsboro Community Development Code (CDC). The CDC may be viewed online at or in the Planning Department office. A copy of the LID Engineers Report has been filed with the City Recorder. A map showing the benefited areas of the LID is shown with this notice and is available for public inspection along with the LID Engineers Report, Staff Report and the applicable criteria at no cost in the City Recorder’s office located at 150 E Main Street, Fifth Floor, Hillsboro, 97123. A copy of all materials can also be provided at a reasonable cost. Materials can be reviewed from 8:00 a.m. to 5:00 p.m. weekdays, excluding holidays. All interested persons are invited to attend this meeting and will be given an opportunity to be heard concerning the proposal. Oral testimony will be taken in the following order: proponents and opponents. Oral testimony should avoid repetition of issues. Pursuant to HMC 3.16.050(A) and (B), testimony will not be considered for the purposes of suspending the proposed change to Sections 1 and 2 of the LID Engineer’s Report unless the person making the testimony also files a written remonstrance with the City Recorder no later than 3:00 p.m. on Monday, October 14, 2019.
