IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF COLUMBIA Case No. 19CV35399 NOTICE AND SUMMONS In the Matter of the Petition of the Board of Directors of the Columbia 9-1-1 Communications District, For a Judicial Examination and Judgment of the Court as to the Regularity and Legality of an Order of the Governing Body Levying a Tax. To: The Columbia 9-1-1 Communications District, an Emergency Communications District, and to all qualified voters, freeholders, taxpayers, ratepayers and other interested persons in Columbia County, Oregon: NOTICE AND SUMMONS is given that a Petition for Judicial Validation has been filed in the above-titled court by the Board of Directors (Board) of the Columbia 9-1-1 Communications District (District). The Petition seeks a judicial examination and judgment of the court pursuant to ORS 33.710 and 33.720 validating the legality of resolutions adopted by the Board, as the governing body of the District, relating to a local option levy. In the May 21, 2019 Special District Election, Measure 5-273 asked the voters to approve a renewal of the Columbia 9-1-1 Communications District’s current local option levy rate of $0.29 per $1,000 of assessed value. However, the ballot title for Measure 5-273 contained a typographical error describing the local option levy rate the voters were asked to approve as being .29 cents per $1,000 of assessed value. The Petition for Judicial Validation asks the court to declare that the District has the authority to impose a local option levy of $0.29 per $1,000 of assessed value beginning the 2019/2020 tax year despite a typographical error in the ballot title. Notice is further given that this Notice and Summons will be published once per week for three successive weeks in the Columbia County Spotlight, a newspaper of general circulation published in Columbia County. Jurisdiction shall be complete upon the Columbia 9-1-1 Communications District, and all qualified voters, freeholders, taxpayers, ratepayers, and other interested persons, within ten (10) days after September 13, 2019, the date of last publication of this Notice and Summons. NOTICE TO INTERESTED PERSONS: READ THESE PAPERS CAREFULLY! At any time before the expiration of the ten (10 days) after the date of completing publication, any interested person may appear and contest the Petition, and any of the acts or things enumerated in the Petition.
