Charter Amendment Imposing Additional Qualifications on City Elected Officers

PUBLIC NOTICE Notice is hereby given that a ballot title for an initiative petition was filed with the City Elections Official for the City of Gladstone on October 7, 2019. The ballot title is as follows: CAPTION: Charter Amendment Imposing Additional Qualifications on City Elected Officers QUESTION: Should the Charter be amended to impose additional qualifications on City elected officers? SUMMARY: Currently, the City’s elected officers are the Mayor and Councilors. The City Charter currently imposes the following qualifications on these City elected officers: — at the time of election, be a qualified elector as defined by the state constitution; — have resided in the City during the 12 months immediately preceding the election; and — maintain a continuous residency in the City during the term of office. The Charter grants the Council authority to be the final judge of the qualifications and election of its members. This measure would amend the Charter to impose additional qualifications on City elected officers. If approved, this measure would prohibit any person from: — receiving compensation for serving; — serving while being employed by the City; or — serving if a relative or member of the person’s household is employed by the City or is currently serving as a City elected officer. If approved, the measure would take effect on January 1, 2021. It would not prevent an elected officer from completing a term of office that commenced prior to this effective date. The City Elections Official has determined this measure meets the requirements of Article IV, Section 1(2)(d) and (5) of the Oregon Constitution. An elector may file a petition for review of this ballot title in the Clackamas County Circuit Court no later than 5:00 p.m. on Monday, October 28, 2019. Any elector who files a petition to review the ballot title must notify the City Elections Official in writing that the petition has been filed no later than 5:00 p.m. on the next business day following the day the petition is filed.
