NOTICE OF PUBLIC HEARING City of Happy Valley Design Review Board Notice is hereby given that the City of Happy Valley Design Review Board will hold a public hearing on the following date regarding an application for design review associated with a proposed 178-unit multifamily residential development. Date & Time: Wednesday, December 11, 2019 at 7:00 p.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086 File & Subject: File No. DR-08-19 (Design Review) Proposal: Design Review of a 200-unit multifamily residential development, a 125-room hotel, and 15,588 square feet of Commercial/Retail Space. The proposed development consists of 200 residential units (which include one and two-bedroom floor plans), a 125-room Hotel, a 367-stall parking garage, a 108 stall temporary/transitional parking lot, a 2,843 square foot restaurant, 12,745 square feet of retail space, and associated landscaping and hardscaping: Location: South of Monterey Avenue and east of Stevens Road. Further described as Clackamas County Assessor Map Number: 12E33DA: Tax Lot 500 Applicant: Veritas Investment Company, LLC Applicable Criteria: Applicable Sections of Title 16 (Land Development Code) of the City of Happy Valley Municipal Code, including Chapters 16.23, 16.41, 16.42, 16.43, 16.46, 16.50, 16.61, 16.62 and 16.65. The decision on the Design Review of the proposed multifamily residential development by the Design Review Board will be made in accordance with said criteria. Failure to raise an issue in writing prior to or to provide sufficient specificity to those issues at the public hearing to afford the Design Review Board an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Design Review Board to respond to the issue precludes an action for damages in circuit court.
