NOTICE OF APPLICATION DI2019-0003 Life Time Fitness Director’s Interpretation

NOTICE OF APPLICATION Pursuant to Section 50.45.4 of the Beaverton Development Code, public notice of the following development application is being provided: DI2019-0003 Life Time Fitness Director’s Interpretation The applicant, LTF Real Estate Company, Inc., requests the director interpret Beaverton Development Code Sections 50.90.3.B.1 and 2 as they related to Life Time Fitness and the Sunset Station & Barnes Road PUD. The request relates to the vested status of the Sunset Station & Barnes Road PUD, as applied to the Life Time Fitness property and project. Additionally the applicant requests the City to determine, if the Sunset Station & Barnes Road PUD is not considered to be vested under BDC Sections 50.90.3.B.1 and 2, what the impact is to the approved Life Time Fitness project. The project is located generally within the vicinity of SW Barnes Road between Highway217 and just west of Cedar Hills Boulevard. Specifically Tax Lots: Map: 1S103AB Tax Lot: 200, Map: 1S103A Tax Lots: 1700, 2200, Map: 1S102B Tax Lot: 500, Map: 1S103AD Tax Lot: 600, Map: 1S102CB Tax Lot: 100, and Map: 1S102CA Tax Lots: 500, 600. To be addressed in the staff report and decision, written comments on the above development proposal shall be submitted no later than 4:30 p.m. on Thursday, December 26, 2019. Failure to raise an issue or failure to provide statements or evidence with sufficient specificity to afford the decision-making authority an opportunity to respond to such issue, may preclude appeal to the Land Use Board of Appeals on that issue. Mailed written comments shall be sent to the Planning Division, PO Box 4755, Beaverton, OR 97076. Written comments submitted in person shall be delivered to the City of Beaverton Planning Division, 4th Floor, Beaverton City Hall, 12725 SW Millikan Way. The decision-making authority for the above application is the Director. Any decision on the above development application shall be based on the Approval Criteria contained in Development Code Section 40.25.15.1.C Director’s Interpretation. Pursuant to Section 50.40.10, on or around January 9, 2020 the Director shall issue a written decision on the application to the applicant, the property owner, and interested parties that submitted written comments prior to or on the comment closing date. Copies of the decision will be made available on the City’s website or may be purchased at the Planning Division Counter or a reasonable cost. Copies of documents and evidence submitted by or on behalf of the applicant, applicable review criteria and the staff report, are available for inspection at the City of Beaverton Planning Division, 4th Floor, City Hall, 12725 SW Millikan Way, between the hours of 7:30 a.m. to 4:30 p.m., Monday through Friday, except holidays.
