Tax ID Nos. 8781, 13053 and 8867 The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which the foreclosure is made is failure to pay when due the annual installment in the amount of $95,836.59** due April 1, 2019 according to the terms of the promissory note, secured by the Trust Deed described above. ** There is also a default by the Grantor or other person owing the obligations, the performance of which is secured by a First Deed of Trust to Northwest Farm Credit Services, FLCA recorded in Jefferson County Records on August 31, 2006 as Recording No. 2006-005355 (First Deed of Trust). This is a foreclosure of a Second Deed of Trust only (described in the first paragraph above). In order to cure the default on this Trust Deed, the First Deed of Trust must also be brought current. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. The true amount due and owing the Beneficiary by the Grantor herein, is as follows: $205,561.61 – principal; $26,277.10 – Interest to 10-14-19; $250.00 – Extension Fee; $1,050.00 – Litigation Guaranty = $233,088.71 Balance due on Trust Deed as October 14, 2019, interest accrues thereafter at the rate of 7.5% per annum ($47.826 per diem), from 10/14/2019, until paid in full plus the costs of foreclosure, attorney’s fees, and trustee’s fees; together with any other sums due or that may become due under the Note or by reason of the default, this foreclosure, and any further advances made by Beneficiary as allowed by the Note and Deed of Trust. Notice is hereby given that the undersigned will on Tuesday, March 10, 2020, at 2:00 o’clock p.m., Pacific Time, on the front steps of the Jefferson County Courthouse, 129 SW E St., Madras, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantor had or had power to convey at the time of the execution by them of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. In addition, stock in the amount of $1,000 must be repurchased in Northwest Farm Credit Services, ACA pursuant to 12 USC 2034 as a condition of cure and reinstatement.
