NOTICE OF PUBLIC ALLEY VACATION

NOTICE OF PUBLIC ALLEY VACATION NOTICE IS HEREBY GIVEN that on Thursday, January 2, 2020 at 7:00 pm, the Gervais City Council will conduct a public hearing to consider the following vacation petition. City Council meetings are held at Gervais City Hall, 592 4th Street in Gervais. FILE NUMBER: VAC 2019-01 REQUEST: The petition submitted to the City of Gervais proposes to vacate the 20 foot wide by 225-foot long public alley within Block 55 of the Gervais Plat. The alley is bound by 5th Street, 6th Street, Alder Avenue, and Birch Avenue. APPLICANT: Fred Kasachev CRITERIA & PROCEDURE: Oregon Revised Statutes Chapter 271, Gervais Development Code 17.132.030, 17.176.020, 17.180.020. Persons wishing to speak for or against the alley vacation may appear in person or by representative at the date and time listed above. Also, written testimony will be received up to one week prior to the hearing at the City of Gervais, 592 4th Street, P. O. Box 329, Gervais, OR 97026. Failure to raise an issue at the hearing, in person or by letter, or failure to provide sufficient specificity to afford the decision-makers an opportunity to respond to the issue precludes appeal of the City Council’s decision to the Oregon Land Use Board of Appeals. A copy of the petition application and all documents relied upon by the applicant are available for inspection at no cost and will be provided at a reasonable cost. A staff report will be available one week prior to the public hearing, for inspection at no cost and provided at reasonable cost.
