CITY OF WEST LINN HISTORIC REVIEW BOARD AND PLANNING COMMISSION PUBLIC HEARING NOTICE FILE NO. DR-21-11 / MISC-21-14 / SGN-21-10 The West Linn Historic Review Board (HRB) will hold a virtual public hearing on Tuesday, March 1, 2022 at 6pm to make a recommendation to the Planning Commission regarding a Class I Design Review and Alteration of a Nonconforming Structure at 1590 Willamette Falls Drive (Clackamas County Assessor’s Map 31E02BB05800). The applicant is requesting approval for the adaptive reuse of a vacant gas and service station into a food cart pod with an indoor pub and indoor and outdoor seating. The Planning Commission will consider the HRB recommendation and make a decision at a virtual public hearing on Wednesday, March 16, 2022 at 6:30pm. The public can watch the meeting online at https://westlinnoregon.gov/meetings or on Cable Channel 30. The HRB and Planning Commission will make their decisions based on applicable criteria found in Chapters 19, 42, 48, 52, 55, 58, 66, 96, and 99 of the Community Development Code (CDC). The approval criteria from the CDC are available for review on the City website http://www.westlinnoregon.gov/cdc or at City Hall and the City Library. The application is posted on the City’s website, https://westlinnoregon.gov/planning/1590-willamette-falls-drive-class-1-design-review-and-alteration-nonconforming-structure. Alternatively, the application, all documents or evidence relied upon by the applicant, and applicable criteria are available for inspection at City Hall at no cost. Copies may be obtained at reasonable cost. The staff report will be available for inspection at no cost, or copies may be obtained at a reasonable cost, at least ten days before the hearing. The hearings will be conducted according to CDC Section 99.170. Anyone wishing to present written testimony for consideration must submit all materials before 12:00 pm on the meeting days to jfloyd@westlinnoregon.gov or mail them to City Hall. The City cannot accept emailed testimony after 12:00 pm on the meeting day. The Historic Review Board and Planning Commission will accept oral testimony at the virtual public hearings. Those who wish to provide oral testimony at the hearing should complete the speaker form https://westlinnoregon.gov/citycouncil/meeting-request-speak-signup before 12:00 pm on the meeting day to receive an invitation to join the meeting. Virtual participants can log in through a computer, mobile device, or call in. It is important to submit all testimony in response to this notice. All comments submitted for consideration of this application should relate specifically to the applicable criteria. Failure to raise an issue in a hearing, in person, or by letter, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond to the issue, precludes appeal to the Oregon Land Use Board of Appeals based on that issue. The final decision will be posted on the website and available at City Hall. Persons with party status may appeal the decision by submitting an appeal application to the Planning Department within 14 days of mailing the notice of the final decision pursuant to CDC 99.240.
