NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS 53rd AVE PARK WEST October 14, 2022 City of Hillsboro 150 E Main St. Hillsboro, OR 97123 (503) 681-6200 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Hillsboro. REQUEST FOR RELEASE OF FUNDS On or about November 7, 2022, the City of Hillsboro will submit a request to U.S. Department of Housing and Urban Development (HUD) for the release of funds under Community Project Funding Grant program authorized by FY 2022 Consolidated Appropriations Act (P.L. 117-103) to undertake the following project: The City of Hillsboro’s first inclusive park and playground, 53rd Avenue Park West is a new, centrally located, 11-acre amenity built to serve our entire community. The park has been designed for people of all ages, all abilities, all backgrounds, and all orientations that connect, create, and strengthen the Hillsboro community. Planned amenities for the park include a mix of active and passive park features, such as a play area, walking paths, natural spaces, planting areas, fitness spaces, games areas, flex spaces to host occasional small events, and other park programming opportunities. The grant from the Community Project Funding (CPF) Award is a critical piece of the funding. In total, the project costs $15M, with $2M of that total as soft costs such as design concepts, construction drawings, construction administration, and permits. The remaining $13M is budgeted for construction. The $3 million in grant funding from CPF is allocated for a portion of the $12 million construction contract. FINDING OF NO SIGNIFICANT IMPACT The City of Hillsboro has determined that the project will have no significant impact on the human environment. Therefore; an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 150 E. Main Street, Hillsboro, OR 97123 and may be examined or copied weekdays from 8AM to 5PM. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Hillsboro Parks and Recreation by contacting Maria Davila Bores at All comments received by November 7, 2022, will be considered by the City of Hillsboro prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONTMENTAL CERTIFICATION The City of Hillsboro certifies to HUD that Robby Hammond in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Hillsboro to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Hillsboro’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Hillsboro; (b) the City of Hillsboro has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed fund, incurred cost, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at 1220 SW 3rd Ave., Suite 400, Portland, OR 97204.
