TRUSTEE’S NOTICE OF SALE
Reference is made to that certain Trust Deed made by Raymond T. Westerlund II, as Grantor, to Western Title and Escrow Company, as Trustee, in favor of Otis Marian Morrow, as Beneficiary, dated November 22, 2006 and recorded on November 22, 2006 in the records of Yamhill County, Oregon, as instrument no. 200626982, Mark F. Bierly having been appointed by the Beneficiary on June 10, 2016 as Successor Trustee, covering the following described real property:
Beginning at the Northwest corner of Lot 2, Block 38 in the TOWN OF LAFAYETTE, Yamhill County, Oregon; thence Easterly along the North line of said Lot 2, 70 feet; thence Southwesterly, parallel with the West line of said Lot and 10 feet West of the East line of said Lot 2, 50 feet; thence Westerly parallel with the North line of said Lot 2, 16 feet; thence Southwesterly, parallel with the West line of Lot 2 and 26 feet West of the East line of said Lot 2, 50 feet to the South line of said Lot 2; thence Westerly along the South line of said Lot 2, 54 feet, more or less, to the Southwest corner of said Lot 2; thence Northerly along the West line of said Lot, 100 feet, more or less, to the point of beginning.
The Beneficiary and Successor Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a Notice of Default has been recorded on August 16, 2016 in the records of Yamhill County, Oregon, as instrument no. 201612764. The default for which foreclosure is made is Grantor’s failure to pay when due the following sums: 1) monthly payments of $400 from January 1, 2016 to date; 2) $400 in late fees; 3) $2669.49 in accrued delinquent interest; and 4) $4036.47 in real property taxes.
By reason of said default, the Beneficiary has declared all sums owing on the obligations secured by the Trust Deed immediately due and payable, those sums being the following: $68,491.73 principal balance with interest at 7% from May 12, 2015 plus $4,436.47 in late fees and property taxes as of August 11, 2016.
Wherefore, notice is hereby given that the undersigned Successor Trustee will on January 10, 2017 at 10:00 a.m. inside the entrance to the Yamhill County Courthouse at 535 NE 5th Street, McMinnville, Oregon, sell at public auction to the highest bidder for cash the interest in the described property which Grantor had, or had the power to convey, at the time of the execution by Grantor of the Trust Deed, together with any interest Grantor or Grantor’s successor in interest acquired after the execution of the Trust Deed, to satisfy the obligations secured by the Trust Deed and expenses of the sale including compensation and expenses of the Trustee as provided by law. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to 5 days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of the principal as would not be then due had no default occurred) and by curing any other default complained herein that is capable of being cured by tendering the performance required under the obligation or Trust Deed, and in addition to paying the sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with Trustee’s and attorney fees as provided by law.
Without limiting the Trustee’s disclaimer of representations or warranties, Oregon law requires the Trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the Trustee’s sale.
