NOTICE IS HEREBY GIVEN that a public hearing will be held before the Hillsboro Planning Commission, at or shortly after 6:30 p.m., on Wednesday, April 27, 2016, in the Shirley Huffman auditorium of the Hillsboro Civic Center, 150 East Main Street, Hillsboro, Oregon. At this hearing, the Commission will consider a request for preliminary plat approval for a 49-lot single family residential Planned Unit Development on one property approximately 5.0 acres in size located in the Witch Hazel Community Plan Area. The newly created lots would consist of 8 new detached homes and 41 attached homes ranging in size from 1,673 square feet to 4,054 square feet. The site has split zoning of MFR-1 and MFR-2 Multi-Family Residential and MU-C Mixed Used Commercial. For lots within the MFR-1 and MFR-2 Zones, the applicant is requesting Major Adjustments to reduce the lot area and setback requirements. For lots located in the MU-C zone, the applicant is requesting Major Adjustments to the side yard setbacks and minimum unit height. The property owners are Lynne Stebbins, Suzanne Backman Yorton and Phillip Backman and the applicant is Chad Bettesworth, Pahlisch Homes, Inc., represented by Matt Sprague, Pioneer Design Group.

The subject property can be specifically identified as Tax Lot 1200 on Washington County Assessor’s Tax Map 1S2-10CB and is generally located north of SE Davis Road, south of SE Lone Oak Street, east of SE Brookwood Avenue and west of SE Aerie Avenue.

The applicable approval criteria for a Planned Unit Development application may be found in the Hillsboro Community Development Code (CDC), Section 12.80.120, Subdivision Criteria is included in Section 12.80.098 and the criteria for a Major Adjustment may be found in CDC Sections 12.80.150 and 12.80.156. The staff report on this matter will be available on Wednesday, April 20, 2016 at 4:00 p.m. The staff report, the application materials, and the applicable criteria are available for public inspection at no cost, or copies can be provided at reasonable cost, from 8:00 a.m. to 5:00 p.m. weekdays, excluding holidays, in the Planning Department at the Hillsboro Civic Center, 150 East Main Street, 4th floor, Hillsboro, Oregon. All interested persons are invited to attend this meeting and will be given an opportunity to be heard concerning the proposal. Oral testimony will be taken in the following order: applicant; other proponents; opponents; and applicant’s rebuttal. Oral testimony should avoid repetition of issues, and should be based on the application or on the approval criteria listed above. ORS 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. If you are unable to attend the hearing, you may submit a written statement to the Planning Director at 150 E Main Street, Hillsboro, Oregon 97123, on or before the hearing date. Telephone conversations cannot be accepted as testimony. Please reference the Case File No.PUD-002-16 on all written testimony.

Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
