PUBLIC NOTICE

PURSUANT TO 44 CODE OF FEDERAL REGULATIONS, SECTION 9.12, THE U.S. DEPARTMENT OF HOMELAND SECURITY’S FEDERAL EMERGENCY MANAGEMENT AGENCY and CLACKAMAS COUNTY HEREBY GIVES NOTICE UNDER EXECUTIVE ORDER #11988, FLOODPLAIN MANAGEMENT, REGARDING THE FOLLOWING PROJECT:

Project Description:  The project involves the flood retrofit-elevation and/or acquisition of substantially flood damaged homes along S. Creek Road in unincorporated Clackamas County.  The County is the project sponsor and applicant.  The project could include up to six substantially flood damaged homes as initially identified in the County’s project application.

Program Funding:  Hazard Mitigation Grant Program from Oregon Disaster 1824-OR.

Statement of Why Action is Located in Floodplain:  The homes were built prior to the establishment of the National Flood Insurance Program (NFIP), within the floodplain of Abernethy Creek.  The floodplain delineation along this stretch of Abernethy Creek does not establish a 100-year flood elevation so the recent January 2009 flood of record will establish the needed elevation to minimize future flood damages

Significant Facts:  The project implements the goals of the Clackamas County Natural Hazards Mitigation Plan, re-adopted in 2007. Homes that are elevated will be in compliance with the County’s NFIP floodplain regulations. For those homes that are acquired, the improvements will be demolished and the ground returned to open space in perpetuity.

Alternatives Considered:  If no mitigation action is taken (elevation or acquisition) the homes will not be in compliance with the County’s NFIP floodplain ordinance and will also likely sustain future flood damages.  “No action” would result in significant future flood damages and associated costs to the NFIP, emergency services provided by the County, and economic and social disruption of the families in future flood events. Each property will be evaluated for the most cost effective mitigation treatment: either elevation or voluntary acquisition.

Applicability of State/Local Floodplain Standards:  The project action conforms to all applicable State/Local floodplain standards.

Affects to the Floodplain:  The structures identified for elevation are located within floodplain and may still suffer some erosion or foundation damage during flooding, and structural and contents damages from floods greater than the January 2009 event. All materials used below the record flood level will be flood resistant to minimize any potential damage, and hydrostatic openings will be provided in the elevated foundations if not open post and pile construction.  The project will have no affect to the floodplains of Abernethy Creek.
